By accessing or using the website located at mercedfencebuilder.com (the "Site"), or by requesting services from MC Merced Fence Builder ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Site or services. These terms apply to all visitors, customers, and others who access the Site or engage our services.
MC Merced Fence Builder provides residential and commercial fencing services in Merced, CA and surrounding communities. Services include but are not limited to fence installation, fence repair, fence replacement, gate installation, and related work. All services are subject to availability, site conditions, and a written project agreement or estimate accepted by the customer. We reserve the right to decline a project request at our discretion.
All estimates provided by MC Merced Fence Builder are based on the information available at the time of the site visit or customer consultation. Estimates are valid for 30 days from the date of issue unless otherwise stated in writing.
Final pricing may change if site conditions differ from those observed during the estimate, if the scope of work is modified by the customer, or if unforeseen conditions are encountered during the job (such as buried obstructions, unstable soil, or utility conflicts). Any such changes will be communicated to the customer before additional work is performed.
Estimates are not guarantees of final cost. A signed written agreement is required before work begins.
Scheduling is subject to crew availability and current workload. We will provide you with an estimated start date, but dates may shift due to weather, permit delays, or other factors outside our control. We will notify you as soon as possible of any schedule changes.
If you need to cancel or reschedule, please notify us at least 48 hours in advance. Cancellations made less than 48 hours before a scheduled start may result in a trip or mobilization fee as specified in your project agreement.
We reserve the right to reschedule work due to unsafe weather conditions, including rain, high winds, or extreme heat. Safety will always take priority over schedule.
Payment terms are specified in your written project agreement. A deposit may be required before work begins, with the remaining balance due upon completion of the project unless otherwise agreed in writing.
Accepted payment methods will be stated in your agreement. Payment is due in full by the date specified. Overdue balances may be subject to a late fee of 1.5% per month, or the maximum rate permitted by California law, whichever is less.
If payment is not received and collection efforts are required, the customer is responsible for any reasonable collection costs, including attorney's fees, to the extent permitted by applicable law.
You are responsible for providing accurate information about your property, including property boundaries and any known underground utilities. While we call 811 before any digging, you should notify us of any private underground lines (such as irrigation, outdoor lighting, or gas lines) that may not be registered with the utility-locating service.
You are also responsible for obtaining any required HOA approvals and for ensuring that the agreed fence line falls within your property. We are not liable for disputes arising from incorrectly identified property lines.
Where required, we will apply for building permits on your behalf and include the permit fee in the project quote. However, it is ultimately the property owner's responsibility to ensure that all work complies with local zoning codes, HOA rules, and applicable regulations. We will make reasonable efforts to advise you of known requirements, but we are not responsible for consequences arising from HOA restrictions or local ordinances that were not disclosed to us prior to the start of work.
We stand behind the quality of our work. Any specific warranty terms will be stated in your written project agreement. In general, our labor warranty covers defects in workmanship for a period of one year from the date of project completion. Materials may carry separate manufacturer warranties, which we will pass through to you to the extent permitted by the manufacturer.
Warranties do not cover damage caused by misuse, vandalism, acts of nature (including wind, floods, or fire), unauthorized modifications, or normal wear and tear. Warranty claims must be reported to us in writing within the warranty period.
Except as expressly stated in a written project agreement, the Site and all information on it are provided "as is" and "as available" without any warranty of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
To the fullest extent permitted by California law, MC Merced Fence Builder and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Site, your reliance on information on our Site, or the performance of any services under a project agreement.
Our total liability for any claim related to services provided shall not exceed the total amount paid by you for the specific project giving rise to the claim. Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you in full.
If a dispute arises between you and MC Merced Fence Builder related to services or these terms, both parties agree to first attempt to resolve the dispute informally by contacting us directly. Most concerns can be addressed quickly with a phone call or email.
If informal resolution is unsuccessful, both parties agree to attempt mediation before pursuing formal legal action. Any legal proceedings shall be conducted in the appropriate courts of California, and both parties consent to the jurisdiction of those courts.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes not resolved informally shall be subject to the jurisdiction of the state and federal courts located in California.
